Under the law, where the employee’s FMLA/CFRA certification is unclear about his health condition and his/her ability to return to work, an employer’s policy may lawfully require an independent medical examination (IME) to determine the employee’s fitness to return to work.

As of January 16, new regulations on the Family and Medical Leave Act (FMLA) enacted by the Bush administration in its final days took effect, which make it harder for employees to take the leave they need to care for themselves or family members. FMLA provides qualified workers with 12 weeks of unpaid leave to recover from a serious health condition, care for a family member with a serious health condition or bond with a new child.
